1 In short
This is a summary, not part of the agreement — the full text below is what is legally operative.
- Instalert is not a marketplace. We sell nothing and buy nothing; you contact the seller yourself.
- Listing content is not ours and we do not verify it. It may be wrong, out of date or already sold.
- We cannot guarantee when an alert arrives — it travels to your phone through Google's and Apple's systems, and your phone's own settings can delay it.
- The free plan is free and stays free. An account never moves to a paid plan on its own.
- You have 14 days to withdraw from a paid plan — see section 9.
- You can delete your account at any time, without asking us.
2 Who provides the service
The service is provided by the person identified in the contact details at the end of this page (“we”). These terms govern your use of the Instalert mobile app and website.
Using the service means you accept these terms. If you do not accept them, please do not use it.
3 What Instalert is
Instalert watches the searches you save on public marketplaces and tells you when a new listing matches one of them, or when a listing it already knew about gets cheaper.
The service is informational. We are not a seller, a buyer, an intermediary, an agent or a broker: we take no part in any transaction and can bear no responsibility for one.
Instalert is not affiliated with myauto.ge, myhome.ge, mymarket.ge, ss.ge, copart.com, livo.ge, myparts.ge or myjobs.ge, does not represent them and does not act on their behalf. All names and trademarks belong to their owners and are used only to identify which site a given filter concerns.
4 Your account
- An account needs an email address and a password. You may also be able to sign in with a Google or Apple account, where that option is available to you.
- An account may be created by a person aged 16 or over.
- One account is for one person. It may not be shared, transferred or sold.
- Keeping your password secret is your responsibility. If you suspect someone else has reached your account, change the password and write to us.
- The email address must be yours and must work — it is the only way a password can be recovered.
5 How the service may be used
You may use the service for your own, non-commercial purposes. You may not:
- Place an unreasonable load on the service or on the source sites, including by automated requests.
- Resell, redistribute, or offer the alerts or the service's content as a service of your own.
- Attempt to reach another account's data, circumvent the service's protections, or interfere with its operation.
- Use the service for an unlawful purpose or in breach of anyone else's rights.
- Decompile or modify the app or the website, or create a derivative product from it.
The number of filters and the minimum interval between checks are capped. Those caps exist so that the source sites are not overloaded, and they are set out on the pricing page.
6 How a contract is formed
- You choose a plan and see its price, what it includes, and the billing period.
- You confirm with a button that states unambiguously that the choice creates an obligation to pay.
- The payment is processed by a licensed payment provider.
- On a successful payment the plan takes effect immediately, and the plan in force together with its renewal date is always visible on the subscription page.
The contract is concluded in Georgian or in English — whichever language you are using the service in. Confirmation of the payment comes from the payment provider; we will supply a receipt on request.
7 Price and payment
- Prices are shown in Georgian lari (₾) and include all applicable taxes. Current prices are always on the pricing page.
- The free plan is free and stays free. An account moves to a paid plan only because you chose it — never on its own.
- We neither process nor store card details; a licensed payment provider does that.
- We may change a price. A change takes effect from the next billing period and you will be told in advance. If you do not accept the new price, you can change or cancel the plan before it takes effect.
8 Renewal and cancellation
A paid plan renews automatically at the end of each billing period, at the price then in force. This happens so that the service is not interrupted.
- You can cancel at any time from the subscription page, in the app or on the website. No call to make, nobody to write to, and no explanation required.
- Cancellation takes effect at the end of the current, already-paid period — you keep using the service until then.
- At the end of that period the account moves to the free plan. No filter is deleted — those beyond the free plan's limit are simply paused, and start again if you return to a paid plan.
- If a renewal payment fails, we will retry it for a short period and tell you. If it still does not succeed, the account moves to the free plan.
9 Your right to withdraw (14 days)
Under the Law of Georgia on the Protection of Consumer Rights, you may withdraw from a distance contract within 14 calendar days of concluding it, without giving a reason.
To withdraw, it is enough to tell us so unambiguously at the address at the end of this page. To meet the deadline it is enough that you send the notice before the period expires.
A paid plan takes effect as soon as it is paid for, which means you are asking us to begin providing the service immediately. Accordingly:
- If you withdraw within the 14 days, we refund what you paid, less the part corresponding to the period already provided.
- The refund is made by the same means you paid, no later than 14 calendar days after we receive your notice. It costs you nothing extra.
- Where the service has already been provided in full for the relevant period, the right to withdraw is exhausted — that is an exception the law provides expressly.
This right concerns a paid plan only. It does not arise on the free plan or during the trial, because nothing was paid.
10 The free trial
- The trial is free and asks for no payment method — neither at the start nor at the end.
- It is offered to an account once.
- The trial does not roll over into a paid plan. When it ends the account moves to the free plan and you are charged nothing.
- Nothing is deleted when a trial ends — filters beyond the free plan's limit are paused.
11 What we do not promise
We send alerts as fast as we can, but we can guarantee neither delivery nor a particular moment, and that has to be said honestly:
- Notifications travel to your phone through Google's and Apple's systems. Those are not ours and we have no influence over them.
- Your phone's battery saving and its manufacturer's settings can delay a notification or suppress it entirely.
- A source site may become temporarily unavailable, change, or restrict access. An alert may then be late or not sent at all.
- The service may be unavailable for a time because of maintenance or a fault.
- We do not promise that every matching listing will be caught, or that you will be the first to reach the seller.
The service is provided “as is” and “as available”, to the extent the law permits.
12 The marketplaces' content
A listing's title, price, description and photograph belong to the marketplace concerned and to whoever posted it. We do not create it, verify it or endorse it, and we take no responsibility for it.
A listing may turn out to be removed, wrong, out of date or already sold. Whether to contact a seller and whether to enter into a transaction is entirely your decision — as is the outcome of it.
If a listing looks doubtful, check it at the original source. The link always travels with the alert.
13 Intellectual property
The Instalert name, logo, app, website and their design are ours. Using the service gives you a personal, non-exclusive, non-transferable and revocable right to use the app and the website in accordance with these terms.
The searches you save are yours. We process them only in order to provide the service to you.
14 Liability
To the extent the law allows, we are not liable for:
- an alert that was missed, late, or never delivered;
- a transaction that did not happen, or one that happened and disappointed you;
- inaccuracy in what a marketplace published, or a fraudulent listing;
- the operation of a source site or any other third party's service;
- lost profit or other indirect damage.
This limitation does not apply to liability that cannot lawfully be excluded — including harm caused intentionally or by gross negligence, and the consumer rights the Law of Georgia on the Protection of Consumer Rights gives you. Nothing in these terms restricts those rights.
15 Ending the service
You may stop using the service and delete your account at any time — Account → Delete account in the app, or /account/delete in a browser. It needs no agreement from us. Deletion is final.
We may restrict or close an account that breaches these terms, harms the service or the source sites, or where the law requires it. We will tell you the reason unless we are forbidden to. If you were on a paid plan and had not breached these terms, we refund the unused period.
We may also decide to discontinue the service or part of it. We will tell you in advance and refund the unused period of any paid plan.
16 Personal data
How we process your data, why, for how long and what rights you have is set out in the privacy policy, which forms part of these terms.
17 Governing law and disputes
These terms and the relationship between you and us are governed by the law of Georgia.
If a dispute arises, write to us first — most are resolved that way and it is faster for both sides. If we cannot agree, you have the right as a consumer to apply to the Competition and Consumer Protection Agency of Georgia, or to a court.
Nothing in these terms limits rights a consumer has under mandatory provisions of law.
18 Changes to these terms
These terms may be updated. The date of the last revision and the version are always at the top of this page.
We will tell you about a significant change in advance, in the app or by email. If you do not accept it, you may stop using the service and delete your account; on a paid plan we refund the unused period.
19 The rest
- If any provision is held invalid, the rest remains in force.
- Not exercising a right immediately does not mean it has been given up.
- You may not transfer your rights or obligations under these terms to anyone else. We may do so only where your rights are not diminished.
- These terms and the privacy policy are the entire agreement between you and us concerning the service.
